1. Acceptance of Terms

By placing an order on MediGear Pro (“the Website”), you (“the User”) acknowledge that you have read, understood, and agreed to be bound by all terms and conditions of this User Agreement, as well as our Privacy Policy and FAQ. This Agreement constitutes a legally binding contract between you and MediGear Pro. You represent that you are of legal age to enter into such an agreement (18 years or older, or with parental/guardian consent if under 18). If you do not agree to these terms, you must not use the Website or place orders.

2. Order Placement & Confirmation

2.1 Order Eligibility

  • Cash on Delivery (COD) is the sole payment method available. COD service is restricted to specific regions; you must confirm availability for your delivery address before placing an order .
  • The Website reserves the right to reject or cancel COD orders at its sole discretion, including but not limited to high regional rejection rates, inability to verify your information, or order value exceeding applicable limits .

2.2 Order Confirmation

  • An order is deemed confirmed when you receive a confirmation email/SMS from the Website. This confirmation does not guarantee shipment until the order is processed and dispatched .
  • You may cancel an order free of charge if it has not been dispatched. For dispatched orders, cancellation requires logistics interception; if interception fails and you Rejection the package, you shall bear the return shipping costs .

3. Payment Terms (Cash on Delivery)

3.1 Payment Requirements

  • Payment must be made in full at the time of delivery, prior to receiving the goods . Accepted payment methods include cash, debit cards, and credit cards (as supported by the delivery agent).

    • Failure to provide payment at delivery will result in the goods being returned to MediGear Pro, and we may restrict your future COD order eligibility .

3.2 No Additional Fees

  • MediGear Pro does not charge any extra fees for COD services. All prices displayed on the Website include the product cost and standard shipping fees (if applicable) .

4. Delivery & Inspection

4.1 Delivery Obligations

  • We will deliver goods to the address provided in your order. You must ensure the address is accurate and that someone is available to receive the delivery at the scheduled time .
  • Delivery timelines are provided as estimates; delays due to force majeure (e.g., natural disasters, logistics disruptions) are not subject to compensation .

5. Returns & Refunds

5.1 Return Eligibility

  • You may request a return within 30 days of delivery for unused, unopened goods in their original packaging. Customized or damaged-after-delivery items are non-returnable .
  • Returns for quality issues must be supported by photos/videos of the defect, verified by our team .

5.2 Refund Process

  • For COD orders, refunds are issued via bank transfer (you must provide valid bank details). No cash refunds are available at delivery .
  • Refunds will be processed within 5–7 business days after we receive and inspect the returned goods. You are responsible for all return shipping costs .

6. Privacy & Data Protection

  • We collect and use your personal information (e.g., name, address, contact details) solely for order processing, delivery, and customer support .
  • Payment information (e.g., card details) is collected directly by our delivery partners and is not stored on our servers . We will never share your personal data with third parties without your consent, except as required by law .

7. Limitation of Liability

  • MediGear Pro is not liable for indirect damages (e.g., loss of use, lost profits) arising from delayed delivery, product misuse, or third-party logistics errors .
  • We guarantee all products meet stated specifications but do not warrant compatibility with third-party devices unless explicitly noted .

8. Modification & Termination

  • We reserve the right to modify these terms at any time. Changes will be posted on the Website and take effect 7 days after publication .
  • We may terminate access to the Website for users who repeatedly violate this Agreement (e.g., frequent unjustified Visa Refusal) .

9. Governing Law & Disputes

  • This Agreement is governed by the laws of the State of California, USA.
